1. Agreement to Terms

By renting a vehicle from West Yorkshire Private Hire Ltd (referred to as “the Company” hereafter), you (referred to as “the Renter”) agree to these Terms and Conditions. These terms govern the entire vehicle rental process, including bookings, vehicle use, payments, and returns.

2. Booking

2.1 Making a Booking

  • Bookings can be made through our website, by phone, or in person at our office. When making a booking, you must provide accurate and complete information, including your personal details, driver’s license information, and payment details.
  • A booking confirmation will be sent to you via email or text message. This confirmation constitutes a binding agreement between you and the Company, subject to these terms and conditions.

2.2 Reservation Hold and Deposit

  • To secure a booking, we may require a deposit. The amount of the deposit will vary depending on the vehicle type, rental period, and your creditworthiness (for first-time renters or in case of high-value vehicle rentals).
  • The deposit will be held as a security against potential damages, late returns, or other violations of these terms. It will be refunded (in full or in part) in accordance with the return and refund policies.

3. Vehicle Rental Eligibility

3.1 Age and License Requirements

  • The Renter must be at least 21 years old. For certain vehicle types (e.g., high-performance vehicles, large trucks), the minimum age may be higher (e.g., 25 years old).
  • The Renter must hold a valid driver’s license that is recognized in the United Kingdom. For international renters, a valid international driving permit (IDP) along with their home country driver’s license is required. The driver’s license must have been held for a minimum of 12 months.

3.2 Driver’s Responsibility

  • The Renter is responsible for ensuring that all drivers of the rented vehicle meet the eligibility requirements. Any driver who operates the vehicle must be listed on the rental agreement (additional drivers may be added for a fee, subject to verification of their license and age).

4. Vehicle Use

4.1 Permitted Use

  • The vehicle is to be used for private or business purposes that are legal and in accordance with all applicable laws and regulations. This includes:
    • Normal transportation needs (e.g., commuting, family trips, business travel).
    • Obeying all traffic laws, including speed limits, parking regulations, and traffic signals.
    • Operating the vehicle only within the United Kingdom unless prior written approval for international travel is obtained from the Company.

4.2 Prohibited Use

  • The following uses of the vehicle are strictly prohibited:
    • Illegal Activities: Using the vehicle for any illegal purpose, including but not limited to transporting illegal substances, participating in criminal acts, or violating traffic laws intentionally.
    • Off-Road Use: Taking the vehicle off-road (unless the vehicle is specifically designated as an off-road vehicle and the rental agreement permits such use).
    • Towing Without Authorization: Towing any trailer or other vehicle without prior written approval from the Company.
    • Racing or Reckless Driving: Using the vehicle for racing, stunt driving, or any other form of reckless driving that endangers the safety of the driver, passengers, or other road users.
    • Smoking or Transporting Pets Without Permission: Smoking inside the vehicle (all our vehicles are non-smoking) or transporting pets without prior written approval (as this may cause damage to the vehicle interior).
    • Overloading: Exceeding the vehicle’s maximum weight capacity as specified by the manufacturer.
    • Unapproved Modifications: Making any modifications to the vehicle, including installing accessories or altering mechanical components, without written consent from the Company.

5. Payments and Charges

5.1 Rental Fees

  • The rental fee is calculated based on the vehicle type, rental period (daily, weekly, monthly rates), and any additional services or features (e.g., GPS rental, child seat rental). The total fee will be clearly stated in the booking confirmation.
  • Payment is due in full at the time of booking or upon vehicle pickup, depending on the payment terms agreed upon. For long-term rentals (exceeding 30 days), we may offer installment payment plans, which must be agreed upon in writing.

5.2 Security Deposit

  • A security deposit will be collected at the time of rental. The amount will be held on your credit/debit card or deducted from your bank account (if paying by direct debit). The deposit amount varies by vehicle type, ranging from £200 for compact cars to £1,000 for commercial vehicles.
  • The deposit will be refunded within 7–14 business days after the vehicle is returned, provided there are no damages, violations, or unpaid charges. Refunds will be processed using the same payment method used to pay the deposit.

5.3 Additional Charges

  • Additional charges may apply for:
    • Late Returns: As per the late return policy (section 1 of Returns & Exchanges). A fee of £20 per hour (up to the daily rate) will be charged for the first 4 hours, after which a full daily rate will apply.
    • Damage to Vehicle: Costs associated with repairing damage beyond normal wear and tear. The Renter will be liable for the full cost of repairs or the security deposit, whichever is higher.
    • Fuel Shortage: Charges for refueling the vehicle if returned with less fuel than the initial level. This includes the cost of fuel plus a £15 administrative fee.
    • Traffic Violations and Fines: Any traffic tickets, parking fines, or toll charges incurred during the rental period. The Renter is responsible for paying these directly or reimbursing the Company if we are required to pay on your behalf, plus a £25 administrative fee per violation.
    • Lost or Damaged Accessories: Charges for replacing lost or damaged accessories such as keys, GPS devices, or child seats. Replacement costs will be specified in the rental agreement.

6. Insurance

6.1 Insurance Coverage

  • The Company provides basic insurance coverage for the rented vehicle, as required by law. This includes third-party liability insurance with a minimum coverage of £5 million, which covers damages or injuries to other people or property in case of an accident where the Renter is at fault.
  • The basic insurance includes a deductible (excess) that the Renter is responsible for in case of an accident or theft. The deductible amount varies by vehicle type, from £500 for standard cars to £2,000 for commercial vehicles.
  • You may purchase additional insurance coverage, such as Collision Damage Waiver (CDW) or Theft Protection, to reduce or eliminate the deductible. Details and costs of these options will be provided during booking.

6.2 Insurance Claims

  • In case of an accident or theft involving the rented vehicle:
    • Immediate Notification: The Renter must notify the Company (phone: +44 7577 028629) and the local law enforcement authorities (e.g., police) immediately. A police report must be filed for all accidents involving injury, third-party damage, or theft.
    • Claims Process: The Renter must cooperate with the Company and the insurance provider during the claims process. This includes providing accurate information about the incident, completing necessary claim forms, and assisting with any investigations.
    • Uninsured Losses: The Renter is responsible for any losses not covered by insurance, including the deductible, damages from prohibited activities, and losses due to failure to report the incident promptly.

7. Liability

7.1 Company’s Liability

  • The Company is liable for defects in the vehicle that exist at the time of rental and cause harm to the Renter or third parties, provided that the Renter has used the vehicle in accordance with the terms of the rental agreement.
  • The Company’s total liability for any claim arising from the rental agreement shall not exceed the total rental fee paid by the Renter.
  • The Company is not liable for:
    • Damages or losses resulting from the Renter’s negligence, improper use of the vehicle, or violation of these terms and conditions.
    • Any indirect or consequential damages, such as loss of business profits, loss of enjoyment, or emotional distress.
    • Loss or damage to personal belongings left in the vehicle, unless caused by the Company’s gross negligence.

7.2 Renter’s Liability

  • The Renter is liable for:
    • All damages to the rented vehicle, regardless of fault, unless covered by insurance and the terms of the insurance policy.
    • All costs associated with towing, storage, and impoundment of the vehicle due to the Renter’s actions (e.g., illegal parking, driving without a valid license).
    • Any fines, penalties, or legal fees incurred by the Company due to the Renter’s violation of laws or these terms.
    • Injury or damage to third parties or their property caused by the Renter’s use of the vehicle.

8. Vehicle Maintenance and Breakdowns

8.1 Maintenance Responsibilities

  • The Company is responsible for ensuring the vehicle is in safe and roadworthy condition at the time of rental.
  • The Renter must report any mechanical issues, damage, or safety concerns to the Company immediately. The Renter shall not attempt to repair the vehicle themselves.
  • The Renter is responsible for basic maintenance during the rental period, such as checking oil levels and tire pressure, and refueling the vehicle as needed.

8.2 Breakdown Assistance

  • All rentals include 24/7 roadside assistance. In case of a breakdown, the Renter should contact our designated breakdown service provider using the phone number provided in the rental documents.
  • If the vehicle cannot be repaired at the roadside, the Company will arrange for a replacement vehicle of similar type, subject to availability, or provide a full refund for the unused portion of the rental period.

9. Termination of Agreement

9.1 By the Company

  • The Company reserves the right to terminate the rental agreement immediately and repossess the vehicle without prior notice if:
    • The Renter violates any of these Terms and Conditions, including but not limited to prohibited use of the vehicle, failure to pay fees, or providing false information.
    • The Renter’s driver’s license is suspended or revoked during the rental period.
    • The vehicle is being used in a manner that endangers the safety of others.

9.2 By the Renter

  • The Renter may terminate the agreement early by returning the vehicle to the Company. However, the Renter will remain liable for the full rental fee unless otherwise agreed upon in writing. Early termination fees may apply as specified in the booking confirmation.

10. Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by the laws of England and Wales.
  • Any disputes arising from the rental agreement shall first be addressed through negotiation between the Renter and the Company. If a resolution cannot be reached, the dispute shall be submitted to mediation before proceeding to litigation.
  • If litigation is necessary, it shall be conducted in the courts of England and Wales, and the Renter agrees to submit to the jurisdiction of these courts.

11. Changes to Terms and Conditions

  • The Company reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. For existing bookings, the terms in place at the time of booking will apply.
